INTRODUCTION
Rule 1.010 of the Florida Rules of Civil Procedure and the Rules of Judicial Administration
encourage the speedy, just and inexpensive determination of every action, and impose on the trial
court the duty to monitor and manage the docket in order to achieve this goal. To that end, these
policies and procedures are published to assist counsel and/or pro se parties appearing in Division
FC-F by addressing routine questions and issues that arise while litigating and trying cases. These
procedures will be revised/updated periodically. They are not intended to relax or supplant the
Florida Statutes, the Florida Rules of Court, local rules of Court, administrative orders, case
specific court orders, the Rules Regulating Florida Bar (including, without limitation, the Rules of
Professional Conduct), or any other substantive or procedural law (collectively, the “Applicable
Law, Rules and Procedures”). All Applicable Law, Rules, and Procedures are intended to prevail,
unless expressly stated otherwise.

A. Communications with the Judicial Office
• Method of Communication: All communications to the judicial office must be submitted
by e-mail to jprather@coj.net. The subject line must contain the case number, style (case
name), and relevant matter.
(Example: 2025 CA 001234 – ABC v. 123 – 30-minute hearing request)
• Ex parte Communications: All communications with the judicial office must comply
with Canon 3 of the Code of Judicial Conduct, which prohibits a judge from initiating,
permitting, or considering ex parte communications and from considering other
communications outside the presence of all parties concerning a pending or impending
proceeding, unless authorized by law. All parties must be copied on any email directed to
the judicial office, unless an ex parte communication is authorized by law.
• Unsolicited Communications: Unsolicited communications from non-parties will not be
considered by the Court. Parties may only contact the judicial office according to these
practices and procedures.
• E-Filing Portal Contact Information: All attorneys and self-represented litigants must
provide an email address to receive signed orders electronically, unless excused. Fla. R.
Gen. Prac. & Jud. Admin. 2.516. It is the responsibility of attorneys and self-represented
litigants to update their contact information using Form 2.603 any time there is a change
in the email account registered for electronic service.

B. Scheduling Procedures
• Scheduling Hearings: Hearings will only be set on motions/petitions already filed with
the Clerk of Court. All hearings must be coordinated with opposing counsel or pro se
parti

Discovery Hearings Are Never Removed From the Calendar — Division CV-F

Treat discovery motions as unbreakable commitments: hearings on Motions to Compel, Motions for Sanctions, Objections to Subpoena, Motions for Protective Order, etc. are in-person, set for 30 minutes, and will not be removed from the calendar for any reason short of complete settlement. Even if resolved, attorneys/parties must appear in person to explain the filing. Remote appearance is not permitted for discovery hearings.

Orders in 10 Days; "Consent" or "Agreed" in the Caption, Never "Proposed" — Division CV-F

Proposed OrdersCV-F — Circuit Civil Division CV-Fhigh confidence
Submit proposed orders via the E-Portal in Word with copies to all parties, accompanied by a cover letter certifying agreement or identifying disagreement, within ten (10) days after the hearing — the Court may require in-person appearance for late orders. Consent orders carry "Consent" or "Agreed" in the caption; never submit an order with "proposed" in the caption.

Zoom Free Under 30 Minutes; Hearings Cannot Be Cancelled Without the Court — Division CV-F

Remote / Zoom HearingsCV-F — Circuit Civil Division CV-Fhigh confidence
Appear remotely without permission only for non-evidentiary hearings of 30 minutes or less. Longer or evidentiary hearings require a motion, good cause, and leave — request remote appearance at least five (5) days before, and provide remote-evidentiary exhibits two business days ahead. Never cancel a set hearing without the Court's consent, and do not assume a filed notice removes it — the JA must confirm. Ex parte hearings are suspended in CV-F.
