UNIFORM MOTION CALENDAR (“UMC”) Every day at 8:45 a.m. to 9:30 a.m. a. General Provisions Among other brief matters, motions regarding discovery disputes, status conferences/case management matters, opposed motions seeking continuance of an evidentiary hearing or trial are regularly heard during this time. These hearings should generally be limited to matters which can be heard within five (5) minutes (2.5 minutes per party). Parties wishing to set matters that require in excess of these limitations should request a special set hearing. UMC matters will be heard on a first-come-first-served basis. If opposing Counsel is not present, please attempt to contact Counsel to inquire as to their status and intentions. b. Scheduling UMC hearing may be set via the online CMS system OR by sending a request with a copy of your Motion to the Judicial Assistant (Div14@17th.flcourts.org). No more than two motions may be noticed for a single case on a motion calendar docket. c. Cancellations Since the number of hearings is limited and the Court attempts to review written materials in advance, please timely cancel any hearings via the online system AND by contacting the Judicial Assistant directly, if and when a matter is resolved prior to your scheduled hearing time. See below CANCELLATIONS. V. CASE MANAGEMENT CONFERENCE (“CMC”) Monday through Friday, 9:30 a.m. to 10:30 a.m. a. General Provisions Parties should be prepared to discuss trial readiness and identify all obstacles to their trial readiness (and proposed solutions thereto) at the case management conference. A Uniform Trial Order, consistent with Fla.R.Civ.P. 1.070, will likely be issued following the CMC, which shall also set deadlines for discovery, motions practice, mediation, proposed jury instructions, &c. b. Scheduling of Trial 1. For Streamlined Track cases, trial should be set within 12 months of filing. 2. For General Track cases, trial should be set within 18 months of filing. 3. For Complex Track cases, trial should be set within 30 months of filing. c. Cancellation of CMC when ALL Parties Agree to Trial Setting within the Assigned Track Whenever all parties have conferred and agree to a particular trial setting, whether a future calendar call in the normal course or a special-setting of the matter, so long as the date complies with the deadlines in Paragraph V.(b.) above, Counsel should simply contact the Judicial Assistant to coordinate the date and the CMC can be cancelled. Any settings beyond the deadlines for the assigned track require a CMC hearing. d. Mandatory Appearance Attendance at CMCs is always mandatory for Counsel, unless specifically excused by the Court. Failure to attend a CMC may result in striking of pleadings and entry of a default. VI. SPECIAL-SET HEARINGS Monday through Friday, 10:30 a.m. to 5:30 p.m.; priority given to the first week of each month All special-set hearings are scheduled by the Judicial Assistant; online scheduling is not available for Division 14. Please send a copy of your motion with a request that includes the amount of time needed to the Judicial Assistant (div14@17th.flcourts.org). Once the request has been reviewed, the Judicial Assistant will contact the parties to coordinate a hearing date. The moving party shall then notice the hearing. LOCATIONS AND HYBRID PROCEEDINGS a. Physical Locations. The drop-off mailbox for Judge Davis’ chambers, No. WW-16-127, is located in the hallway near the elevator bank on the 16th floor of the West Wing. Division 14 hearings are held in Courtroom No. WW-16-155, located on the sixteenth floor of the West Wing of the Broward County Central Courthouse, 201 Southeast Sixth Street, Fort Lauderdale, Florida 33301. b. Virtual Locations (Zoom videoconferencing). For remote appearances, via the Division FB Zoom Meeting ID 277-567-705, Courtroom 16-155 is equipped with a camera system and other technology to allow viewing of each court session.
