INTRODUCTORY
Promulgation. These rules shall beknown astheLocal Rules fortheDistrict
Court oftheState ofWashington forDouglas County. These rules willbeeffective
September 1,2024, unless otherwise stated, andsupersede allprior rules ofthis court.
Theprovisions ofthese local rules aresupplemental totherules adopted bythe
Supreme Court oftheState ofWashington forcourts oflimited jurisdiction, and shallnot
beconstrued inconflict withthem.

ELECTRONICFILINGANDSERVICE
A. Electronic filing (“eFile”) authorization, charges, exceptions, andwaiver.
1. Mandatory Electronic Filing. Effective November 30,2024 (30days aftergo
live),attorneys shall electronically file (eFile) alldocuments using thecourt’s
designated eFiling service, eFile &Serve, unless thisruleprovides otherwise.
Non-attorneys orproseparties arenotrequired toeFile butareencouraged to
doso.
2. Documents ThatShall NotBeeFiled. Thefollowing documents maynotbe
eFiled:
a)Acriminal case initiation document (e.g.,complaint, citation, ornotice of
infraction) thatisnotsubmitted through theStatewide Electronic Collision
Traffic Online Records (SECTOR) application perGR30(d)(ii);
b)Adocument thatisrequired bylawtobefiledinnon-electronic format, for
example, certified records ofproceedings forpurposes ofappeal,

negotiable instruments, anddocuments offoreign governments under
official seal;
c)Documents incapable oflegible conversion toanelectronic format by
scanning, imaging, orany other means;
d)Documents larger than permitted intheUserAgreement.
3. Working Copies. Attorneys andothereFilers arenotrequired toprovide
duplicate paper pleadings as “working copies” forjudicial officers.
4. Waiver ofRequirement toeFileforattorneys.
a)Ifanattorney isunable toeFile documents, theattorney may request a
waiver from thecourt. Theattorney must make ashowing ofgood cause
andexplain whypaper document(s)must befiledinthatparticular case.
Thecourt willconsider each application andprovide written approval or
denial totheattorney. Attorneys whoreceive awaiver shall fileacopy of
thewaiver ineach case inwhich theyfiledocuments. Attorneys who
receive awaiver shall place words “Exempt fromeFiling perwaiver filed
on (specified date)” inthecaption ofallpaper documents filedforthe
duration ofthewaiver.
b)Upon showing ofgood cause thecourt maywaive therequirement astoa
specific document ordocuments onacase-by-case basis.
B. Mandatory Electronic Service. Pursuant toGR30(b)(4)thecourt mandates that
onallcase types attorneys forparties ofrecord shall accept electronic service of
documents, including service byemail.

DISCLOSUREOFPUBLICRECORDS
Access toconfidential records isstrictly limited topersons orentities authorized
bystatute orcourt order toobtain such records. Request foraccess tocourt records
shall bemade inwriting ontheform provided bytheCourt andshall begranted or
denied onlybyajudge, ordesignee, whoshall state thereasons fordenial inwriting.
Anyperson objecting toadenial ofaccess mayfileaMotion forReconsideration with
supporting affidavit. Costs ofresearching, copying andtranscribing shall bepaid in
advance bytheperson orentity asking forsuch copies. Nodocuments orelectronic
data may beremoved from thecourt offices without thewritten order ofthecourt.

CIVILJURYTRIAL
A)Demand. Therequest forjury trialincivilcases shall bemade byfiling ademand
withtheclerk andpaying thejury feenotlater thanseven days fromthedateofthetrial
setting notice issued from thecourt. Failure tocomply withthisruleisawaiver ofthe
right toajurytrial.
B)Imposition ofcosts. Whenever anycause assigned forjurytrialissettled orwillnot
betried bythejuryforanyreason, notice ofthat factshall begiven immediately tothe
court. Ifnotification isnotgiven forty-eight hours prior tothetimeofthetrial, andinany
event after thejuryhasbeen summoned orally orinwriting, thecourtinitsdiscretion
mayorder payment oftheactual costs ofthejury panel bytheoffending party.
NOTE: THERE ISNOPROVISION FORREFUND OFTHE JURY FEES.)
C)Pre-trialProcedure. Allcases setforjurytrialshall besetforpre-trialconference,
which shall beheld atleast twoweeks prior totrial. Theattorneys whoaretoconduct
thetrialandallparties shall bepresent toconsider such matters aswillpromote afair
andexpeditious trial. Alldiscovery should becompleted fivedaysprior tosaid
conference. Opposing counsel orparty must begiven fiveday’snotice ofpre-trial
motions tobeheard atthepre-trialconference. Anypre-trialmotions requiring the
testimony ofwitnesses forargument may, inthediscretion ofthecourt, becontinued to
thedayoftrial. Allamendments, pleadings and motions should bemade orbe
completed atthisconference. Upon failure toappear, thejudge mayproceed withthe
conference exparte, andenter anyappropriate order including striking thejurydemand
andmayimpose terms. Insofar aspracticable theconference shall deal withanymatter
cognizable bySuperior Court Rule CR4.5,andfailure toraise that matter mayresult in
thewaiver ofthesame.

ATTORNEYFEES
Incivildefault cases where attorney fees areauthorized bystatute orbywritten
agreement, thefollowing schedule shall bedeemed reasonable inalldefault cases
unless theparties present evidence ofcircumstances thatconvinces thecourt thata
larger orsmaller feeshould beawarded, provided, however, thecourt shallhave
authority tovary from this schedule onitsownmotion:

Forjudgments exceeding $5,000, reasonable attorney fees maybeallowed of

NSF checks. When RCW 62A.3-515has been followed, reasonable attorney
feeswillbeawarded inanamount tobedetermined byreference toRCW 12.20.060
unless theattorney convinces thecourt thatalarger feeshould beawarded and
provides anitemized affidavit astoactual timespent andhourly rateexpended bythe
attorney inthecase, inwhich case thecourt shall determine areasonable fee. A
reasonable handling feeawarded pursuant to62A.3-515shall notexceed $40per
check.
Where onlystatutory attorney feesareauthorized, thedefault judgment shall
include, andthecourt willapprove, onlyattorney feesinthestatutory amount as
applicable atthetimeofentry ofjudgment.

PRE-TRIALHEARING/MEDIATIONCONFERENCE
Upon thefiling ofaSmall Claim case aPre-TrialHearing/Mediation Conference
shall beset. Thenotice ofPre-TrialHearing/Mediation Conference shall beserved with
theNotice ofSmall Claim. Bothparties mustattend thePre-Trial Hearing/Mediation
Conference. Parties shall bring three copies oftheirevidence tothehearing. No
witnesses willbeallowed atthehearing. Failure tobring copies ofevidence asnoted
above tothehearing mayresult inthePre-TrialHearing/Mediation Conference being
continued. AtthePre-Trial Hearing thecourt willreview anddiscuss withtheparties

theirdocuments, evidence, discovery, exhibits, and explain trial procedure andcourt
expectations.
Upon conclusion ofthePre-Trial Hearing theparties willimmediately bedirected
toreport andattend mediation inoneofthecourt’savailable courtrooms orourcounsel
rooms. Mediation ismandatory before atrialisallowed. Both parties must attend the
mediation, unless excused bythecourt. Iftheplaintiff fails toattend themediation
conference, adismissal willbeentered. Ifthedefendant failstoattend themediation
conference theiranswer, ifone wasfiled, willbestricken and adefault judgment
entered. Nowitnesses willbeallowed atthemediation. Attorneys and paralegals may
notrepresent parties atmediation.
Thepurpose ofmediation istosettle thecase ifpossible. Ifsettlement is
reached after mediation, bothparties, andtheassigned mediator, shall report tothe
clerk counter tonotify thecourt andfiletheagreement. Ifnosettlement ismade at
mediation, bothparties shall report totheclerkcounter andinform theclerkthat no
resolution hasbeen reached andtheclerkwillsetatrialdateforthecase and provide
notice ofthetrialdatetotheparties. Nofurther notice willbeprovided totheparties of
thetrialdate.
Iftheparties have already submitted thecase toanother typeofmediation or
arbitration service, thecase maybesetfortrialdirectly after thePre-TrialHearing, at
thecourt’sdiscretion.

CONTINUANCEOFPRE-TRIALHEARING/MEDIATIONCONFERENCE
Ifaparty isseeking acontinuance ofaPre-TrialHearing/Mediation Conference,
theyshallmake awritten motion forcontinuance, which must beserved onthe
opposing party and filedwiththecourtatleast fivedays prior tothehearing date. The
motion must state thereasons forthecontinuance request. Themotion tocontinue must
include information about whether theopposing party hasagreed totherequest to
continue. The Judicial Officer willconsider ifgoodcause exists tocontinue thematter
andwillnotify theparties.

EVIDENCE
1.Itistheparty’sresponsibility toensure thatexhibits areproperly filedwiththe
Court. Itistheparty’sresponsibility toremove anysensitive orconfidential information,
i.	e.social security numbers, birth dates, account numbers, etc.
2.Evidence shall beexchanged bytheparties atthePre-TrialHearing. Ifthe
case isproceeding toTrial, anyadditional evidence shall befiledwiththecourtand
exchanged between theparties atleast 5days prior toTrial.
3.Document filing islimited to100total pages percase, andalldocuments must
befiledon8½”x11”paper. DONOT include binders, page protectors, paper clips,
staples, ortabs.

CONTINUANCEOFTRIAL
Theparty requesting acontinuance ofTrial must contact theotherparty toseek
agreement forthecontinuance. Iftherequest tocontinue isagreed bytheparties, both
parties must contact theCourt inperson, bywriting, orbytelephone tonotify theCourt
oftheagreed continuance. Ifoneparty willnotagree tothecontinuance, theparty
seeking thecontinuance maymake awritten motion forcontinuance andsetahearing
dateprior tothetrial date. Themotion andnotice ofhearing must beserved onthe
opposing party notlessthanfivedays prior tothedate setforthemotion tocontinue. At
thehearing, theJudicial Officer willmake theruling ifthematter willbecontinued.
Iftherearelessthanfivedays priortotheTrialdatetoserve theopposing party,
theparty requesting thecontinuance maycontact theCourt toexplain the
circumstances which require theTrial datetobecontinued. Thematter maybe
continued bytheCourt upon showing ofgood cause.

CRIMINALRULES
LCrRLJ3.1(d)
RIGHTTOANASSIGNMENTOFCOUNSEL
Indigent defendants shall have counsel appointed torepresent them inall
criminal cases unless theright tocounsel iswaived. Indigency shall mean aninability to

payanattorney areasonable feefortheservices, which appear toberequired by
reasons ofthecrime charged without substantial hardship tohimself orhisfamily.
Defendants whorequest appointment ofcounsel shall berequired topromptly execute a
financial disclosure under oathonaform supplied bythecourt.
Upon appointment ofcounsel forindigent criminal defendants, theClerk shall
promptly provide counsel withnotice oftheappointment.
Attorneys representing defendants incriminal cases must serve prompt written
notice oftheir employment upon theprosecuting attorney andfilethesame withthe
clerk ofthecourt. The attorney must certify tothecourt that heorshecomplies with
theapplicable Standards forIndigent Defense approved bytheSupreme Court.

LCrRLJ3.1(e)
WITHDRAWALOFATTORNEY
Whenever acase hasbeensetfortrial, nolawyer shall beallowed towithdraw
except upon theconsent ofthecourt forgood cause shown andupon thesubstitution of
another lawyer orupon thedefendant’sknowing andvoluntary decision toproceed
without alawyer. Consent may bedenied ifnecessary toprevent acontinuance.
Court appointed counsel shall beautomatically terminated ascounsel ofrecord
upon thefollowing:
1) entry ofanorder forbench warrant;
2) entryofasentence following apleaofguilty;
3) attheconclusion ofthe30-dayappeal period following sentencing asaresult
ofconviction after trial; or
4)entryofanorder deferring sentencing, adispositional order ofcontinuance
SOC), anorder deferring prosecution, orany finaldisposition which isappealable
provided that; incases involving asubsequent hearing asadirect consequence ofthe
sentence, such asarestitution hearing, representation willterminate upon completion of
such hearing.

CONTINUANCES
After thefirstcourt appearance bydefendant allrequests tocontinue apre-jury
trialconference, pre-trialhearings, motion ortrialwillrequire awritten order of

continuance willbeaccepted after noon ontheday before thelawand motion calendar.
Thecourt willnotcontinue thetrialorhearing datebeyond theCrRLJ 3.3dates without
aspeedy trialwaiver.
Requests forcontinuance ofprobation compliance review, motion torevoke
deferred prosecution, orprobation violation hearing maybesubmitted byletter or
motion tothecourt forconsideration offtherecord.

CRIMESREQUIRINGDEFENDANT'S
APPEARANCEATARRAIGNMENT
Alawyer maynotenter awritten pleaofnotguilty onbehalf ofaclient, ifthe
charging document states thatoneormore ofthecharges involves domestic violence,
harassment, violation ofananti-harassment orprotection order, stalking, ordriving
while under theinfluence ofintoxicants, driving while under theageof21after having
consumed alcohol, orphysical control ofavehicle while under theinfluence of
intoxicants. Forsuch charges, thedefendant must appear inperson forarraignment;
andthecourt shall determine thenecessity ofimposing conditions ofpre-trialrelease.

LCrRLJ4.2
DEFERREDPROSECUTION
Apetition fordeferred prosecution pursuant toRCW 10.05must befiledwith the
court nolater thanseven (7)days priortoreadiness hearing unless good cause exists
fordelay. Thepetition andtheaccompanying declarations shall beinaform set
forth inCrRLJ 4.2. Acomplete copy ofthepolice report ofthedefendant'sconduct
giving risetothecharge shall beattached tothepetition. The Order forDeferred
Prosecution shall provide supervision for60months, completion ofatreatment

plan, payment ofcosts, abstinence fromconsumption ofalcohol andnon-prescription
drugs, notraffic offenses, arequirement thatallvehicles driven bythedefendant be
equipped withanignition interlock device asrequired bystatute andnodriving
without aproper license andinsurance. Other conditions ofsupervision maybe
imposed inthecourt’sdiscretion.

WITNESSES-PROCESS-SUBPOENAS
When application ismade forasubpoena forawitness residing outside of
Douglas County andtheGreater Wenatchee area, such application shall be
accompanied byanaffidavit showing tothesatisfaction ofthecourt themateriality ofthe
testimony which isexpected tobeobtained fromsuch witness. The court inits
discretion maywaive thisrequirement.
Preparation ofsubpoenas shall betheresponsibility oftheapplicant and shallbe
submitted with theapplication requesting issuance ofthesubpoena. Service ofthe
subpoenas shall betheresponsibility oftheapplicant.

PRE-JURYTRIALCONFERENCE/READINESSHEARING
6.1(a)Pre-JuryTrialConference
Inevery criminal case inwhich therighttotrial byjuryhasnotbeen waived, there
willbeapre-jury trialconference forthepurpose ofpresenting and scheduling motions
andforsetting areadiness conference andjurytrialdate.
Theprosecuting attorney, defense counsel and thedefendant arerequired to
attend thepre-jury trialconference, unless otherwise excused bythecourt. Failure of
thedefendant toappear atanypre-trialhearing mayresult intheissuance ofabench
warrant andforfeiture ofbailand/orbond.
6.1(b)Readiness Hearing
Areadiness hearing shall besetinallcases setforjurytrial. Theprosecuting
attorney, defense counsel and thedefendant arerequired toattend thereadiness
hearing, unless otherwise excused bythecourt. Failure ofthedefendant toappear at
thereadiness hearing mayresult intheissuance ofabench warrant, forfeiture ofbail
and/orbond, andstriking oftrial.

Atthereadiness hearing, theparties shallindicate theirreadiness fortrialand
advise thecourt ofanyfactors affecting readiness fortrial; such as,exchange ofwitness
lists, availability ofwitnesses, andunresolved motions. Upon conclusion ofthe
readiness hearing, thecourt willaccept amendment ofcharges onlyupon good cause
shown.
Any case confirmed forjurytrialatthereadiness hearing thatdoes notproceed
totrial, absent goodcause, maybesubject tosanctions asdeemed appropriate bythe
judge, including butnotlimited toactual jurycosts, witness fees, and terms.

MOTIONS
Atthepre-jury trialconference, theparties must state withspecificity allmotions.
Ifthemotion hasnotbeensubmitted inwriting withsupporting memorandum of
authorities before orduring thepre-jurytrialconference, thecourt willestablish a
briefing schedule. Thecourt willdetermine ifanevidentiary hearing isrequired andwill
setatime forhearing onthemotion(s).Ifaproper motion isnotreceived bythecourt
10days prior tothescheduled hearing, themotion hearing willbestricken.
Except ongood cause orastoroutine matters, e.g.,amotion toexclude
witnesses, motions inlimine andsupporting memoranda, shall befiledatleast one
business dayprior totrial.

CONTESTEDINFRACTIONHEARINGS –PRELIMINARYPROCEEDINGS
3.1(a) Subpoenas. Incontested cases, thedefendant andtheplaintiff maysubpoena
witnesses necessary forthepresentation oftheir respective cases. The request fora
subpoena maybemade inperson orbymail. Inorder torequest asubpoena, the
request must bemade inwriting informing theclerk ofthecourt ofthename and
address ofthewitness andofthedateofthecontested hearing. Thesubpoena maybe
issued byajudge, judge pro-tem, clerk ofthecourt, orbyaparty’sattorney. The
responsibility forserving subpoenas onwitnesses, including lawenforcement witnesses
andtheSpeed Measuring Device Expert (SMD Expert) isupon theparty requesting the
subpoena. Such subpoenas maybeserved asstated inIRLJ 3.1(a).
b) Timeliness. Incases where therequest forasubpoena ismade 14days orless
prior tothescheduled hearing, thecourt maydeny therequest forthesubpoena or
condition theissuance ofthesubpoena upon acontinuance ofthehearing date.
c) Speed Measuring Device Expert. Defense requests foraSpeed Measuring Device
Expert must bemade totheOffice oftheProsecuting Attorney, ortotheCourt if
defendant ispro-se,nolessthan30-days priortothedatesetforthecontested hearing.
Therequest shall becontained inaseparate document clearly designated asarequest
foranSMD expert. Arequest foraSMD expert may betreated bytheCourt asa
request foracontinuance tothenextdateonwhich theprosecuting attorney has
scheduled theappearance oftheSMD Expert. AnSMD expert called asawitness by
either party may testify bytelephone; however, any party intending toelicit telephonic
testimony from anSMD expert shall notify thecourt andopposing party atleast five
days prior tothedatesetforthecontested hearing.
d)Continuances. Requests forcontinuances byaparty orparties willrequire awritten
order, ifagreed, ormotion andorder ifthecontinuance isnotagreed. Thecourt will
consider such request(s)inchamber and willnotify theparties ofitsdecision. No
continuance willbeconsidered oraccepted bythecourt iftherequest isnotreceived at
least 48hours prior tothedateandtimeofthescheduled hearing.
e) Costs andWitness Fees. Each party isresponsible forcosts incurred bythat party,
including witness fees, assetforth inRCW 46.63.151. Incases where aparty requests
awitness tobesubpoenaed, theparty requesting thewitness shall paythewitness fees
andmileage expenses duetothatwitness.

Adefendant mayfileawritten motion onforms provided bythecourt tosetaside

Thecourt willconsider thewritten motion inchamber andissue awritten decision. Only
onemotion shall beallowed onanycase. Amitigation hearing maybegranted upon
setting aside thejudgment. Acontested hearing shall notbeallowed unless byspecial
written order.

REPRESENTATIONBYLAWYER
Atacontested hearing where anattorney hasappeared forthedefendant or
witnesses have been subpoenaed, alawyer representative oftheProsecutor'soffice
shall appear. Adefendant charged withatraffic infraction andrepresented bycounsel
must provide written notice totheprosecuting authority andclerk ofthecourt ofsuch
representation atleast seven days from thedatetheoriginal request foracontested
hearing ismailed bythedefendant. Upon receipt ofcounsel'snotice ofappearance, the
clerk shall reset thecontested hearing totheappropriate calendar. Thefailure totimely
fileanotice ofappearance mayresult inthecontested hearing being heldbeyond the
120days from thedateofthenotice ofinfraction orthedatethedefault judgment was
setaside, asrequired byIRLJ 2.6(a).
