Texas discovery — which Level governs
Every Texas suit runs under a discovery-control plan (Tex. R. Civ. P. 190), and the plaintiff must plead the level. The level sets your deposition hours, your interrogatory count, and your discovery period. Level 1
Suits where all claimants (other than counter-claimants) affirmatively plead monetary relief of $250,000 or less — including any expedited-action overlay (TRCP 169).

Level 2
Every suit not in Level 1 or Level 3 — the default plan (TRCP 190.3).

Level 3
Suits where the court, on motion or its own initiative, orders a tailored discovery-control plan (TRCP 190.4).
